The development approval at False Cape was refused and under the Integrated Planning Act, this means that a development cannot proceed. However Cairns City Council has seen fit to issue an operational works permit to allows the developer to carry on as though he did get a development approval. This is the most blazon abuse of our system of government that I have personally experienced.
False Cape was burning issue that created the impetus for Future of Cairns. This proposed development represents everything that is wrong with the development approval process in Cairns and Australia in general.
The Cairns Post had a telephone poll on whether the people of Cairns thought that the proposed development at False Cape should proceed. Unfortunately this poll did not to our knowledge exclude people from voting multiple times. I voted 3 times in quick succession (for 3 members in my household) on the same phone line and each time the vote appeared to be tallied. A more objective idea of the popularity of the proposed development can be obtained from looking at submissions that people produced regarding the proposed development at False Cape.
FutureOfCairns has been accused of making misleading statements about False Cape in the leaflet that was delivered to the households of Cairns. In particular, the developer’s lawyers objected to the photographic material. Actually the biggest and meanest lawyers in Queenland have threatened to sue our pants off over the contents of that leaflet. A claim made by one of the False Cape developer’s representatives was that the leaflet that was distributed to the households of Cairns had photo taken with a zoom lens to exaggerate the proximity between False Cape and Machans Beach and was therefore false and misleading. In fact we were threatened with legal action if we did not withdraw the image. This was unnecessary, as if any information on this web-site can be shown to be distorted, it will be removed. Of all the many things that are not true about the proposed False Cape development, the claim that it will not be visible from the Esplanade is the most obvious and most easily debunked untruth. This issue was therefore selected to test our councillors and is why images of False Cape, taken from the Esplanade were on the front of the False Cape leaflet from FutureofCairns.
If you have been visiting FutureOfCairns then keep visiting, as thingsare really starting to happen. We are still waiting for any ofthe politians who have blasted us in the media or the developer and hisconsultants to demonstrate why any of the inconvenient material that wehave presented here is false.
